Summit Bikes Terms and Conditions of Use

PRODUCT WARRANTY

This warranty is extended only to the original end-use purchaser or the person receiving the product as a gift, and 
shall not be extended to any other person or transferee.

What is covered/for how long? 

All Parts and Products are covered by our handover warranty from the date of purchase by the original end-use purchaser. Summit Bikes warrants that this product, when delivered or handed over to you in new condition in the original packaging and used under normal conditions is free from any defects in manufacturing, material and workmanship. Products may be returned at the buyer’s discretion and expense and will be scrutinized by thorough inspection should reasonable doubt exist that any irregularities or faults with products are due to any defects. Products found to be damaged due to improper handling; unauthorized modification, shock, torsion, twisting, over-stressing and dismantling will not be replaced or refunded. Repairs to devices will be at the Owner’s expense.

What is not covered?

Scratches, fading, damage to finish - We inspect every product before it ships to ensure that it arrives to you in perfect condition. If there are any problems with the finish, this should be reported to us within 24 hours of receiving your new device. Beyond this period, we cannot replace the product for scratches, blemishes, fading.  As with any coated product they can wear or scratch with daily use.

What we will do:

We will replace any defective items covered by the Warranty free of charge, within a reasonable period of time.  What you must do to obtain Warranty Service:

1. Contact Summit Bikes via e-mail for specific return and shipping instructions. 
2. Label and ship the product to the address "Summit Bikes, Shop2, 22 Oxford Street, Durbanville, Cape Town, 7550" include a copy of your original order and explanation of the problem or reason for return with the return. Packages not bearing a return authorization number, where required, will be refused.

Other conditions:

THE PROVISIONS OF THIS WARRANTY ARE IN LIEU OF ANY OTHER WARRANTY, WHETHER 
EXPRESSED OR IMPLIED, WRITTEN OR ORAL, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Summit Bikes (PTY) LTD. MAXIMUM LIABILITY SHALL NOT EXCEED THE ACTUAL PURCHASE PRICE PAID BY YOU FOR THE PRODUCT. IN NO EVENT SHALL SUMMIT BIKES BE LIABLE FOR LOSS OF, DAMAGE TO OR FOR SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES HOWSOEVER CAUSED INCLUDING WITHOUT LIMITATION THE REPLACEMENT OF EQUIPMENT AND PROPERTY, WITH YOUR Summit Bikes PRODUCT.

ALL USERS OF THIS SITE AGREE THAT ACCESS TO AND USE OF THIS SITE ARE SUBJECT TO THE FOLLOWING TERMS AND CONDITIONS AND YOUR USE OF THIS SITE CONSTITUTES AN AGREEMENT ON YOUR BEHALF TO THE TERMS AND CONDITIONS OF THIS SITE AND OTHER APPLICABLE LAWS. To the fullest extent permissible pursuant to applicable law, Summit Bikes, disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement. Summit Bikes, does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. Summit Bikes, does not make any warranties or representations regarding the use of the materials in this site in terms of their correctness, accuracy, adequacy, usefulness, timeliness, reliability or otherwise. Some Countries/States do not permit limitations or exclusions on warranties, so the above limitations may not apply to you. 

LIMITATION OF LIABILITY

Summit Bikes, under no circumstances, shall be held liable for any direct, indirect, incidental, special or consequential damages from the use of, or the inability to use, the information or products 
received from this site, even if Summit Bikes, has been made aware of the possibility of such damages. We will not be held liable for any loss of personal injury in conjunction with the use of or misuse of the products and information acquired through our site and you agree your use of our products is at your sole discretion and risk. Our maximum liability in any event will be of that equal to the purchase price of the product you buy. Some Countries/States do not permit the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you, but will apply to the maximum extent permitted by your Country/State. 

TRADEMARKS

All trademarks, service marks and trade names of Summit Bikes, used in the site are trademarks or registered trademarks of Summit Bikes. 

PAYMENT

You agree to pay for all products purchased through this site under your account by any person by one of the following methods: bank transfer or cas on delivery. You also agree to pay for any fees we may incur in relation to collecting payment from you in the event you do not pay us for purchases under your account. 

PARTICIPATION DISCLAIMER

Summit Bikes, does not and cannot review all communications and materials posted to or created by users accessing the site, and is not in any manner responsible for the content of these communications and materials. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Summit Bikes, is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, Summit Bikes, reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or other intellectual property right of another or (d) offensive or otherwise unacceptable to Summit Bikes, in its sole discretion. 

REVISIONS TO TERMS AND CONDITIONS

Summit Bikes, may at any time make any changes to these terms and conditions. It is your responsibility, not the company, to occasionally check the terms and conditions to assure that you fully understand the terms to which you agree to by using our site. The company is not required to issue a statement as to changes made to the terms and conditions.  These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Summit Bikes, without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer,  Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Summit Bikes, may deliver notice to you by means of e-mail, a general notice on the site, or by other reliable methods to the address you have provided to Summit Bikes. 

TYPOGRAPHICAL ERRORS

In the event that a Summit Bikes, product is mistakenly listed at an incorrect price, Summit Bikes, reserves the right to refuse or cancel any orders placed for product listed at the incorrect price. Summit Bikes, reserves the right to refuse or cancel any such orders whether or not the order has been confirmed. Summit Bikes shall issue a credit to your bank account in the amount of the incorrect price. We reserve the right to correct the mistake and adjust it so the correct value is issued. 

MISCELLANEOUS

Your use of this site shall be governed in all respects by the laws of South Africa, RSA, without regard to choice of law provisions. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Summit Bikes, products) shall be in the state or federal courts located in South Africa. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Summit Bikes, products) must be commenced within one (1) year after the claim or cause of action arises. Summit Bikes, failure to insist upon or enforce strict performance of any provision of these terms and conditions shall not be construed as a waiver of any provision or right. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Summit Bikes, its officers, directors, employees, agents, licensers and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

Harassment in any manner or form on the site, including via e-mail, chat, or by use of obscene or abusive language is strictly forbidden. Impersonation of others, including an Summit Bikes, or other licensed employee, host, or representative, as well as other members or visitors on the site is prohibited.
